These Terms and Conditions govern purchases made through the Omnisculpta online store. Omnisculpta sells decorative items and artworks exclusively within Hong Kong. By placing an order, you acknowledge that you have read, understood, and accepted these terms. Please review them before completing checkout. Questions may be sent to collective@omnisculpta.com.
1. Our Customer Agreement
These terms form the agreement between Omnisculpta and the customer named in an accepted order. They apply to website use, orders, delivery, payment, cancellation, returns, exchanges, and refunds.
An order submitted through our website is a request to purchase. We may decline an order when an item is unavailable, customer information is incomplete, a delivery address falls outside Hong Kong, or earlier failed deliveries require additional review. An order becomes accepted when we send an order acknowledgment or begin processing it.
2. Hong Kong Service Area
Omnisculpta operates solely within Hong Kong. We accept orders only for addresses located within Hong Kong and do not provide international shipping.
Customers must submit a complete recipient name, telephone number, and accessible delivery address. Incorrect or incomplete details may cause delay or prevent delivery. Customers should contact collective@omnisculpta.com promptly if submitted information requires correction.
All accepted orders receive free shipping. We do not add shipping, handling, or doorstep delivery charges.
3. Product Information
We aim to describe each decorative item and artwork clearly through images, dimensions, materials, colors, and other relevant details. Screen settings, lighting, handmade finishes, and natural material variations may cause minor visual differences.
Customers should review product information, measurements, quantity, and placement requirements before ordering. Decorative items must be used for their intended indoor or stated purpose. Website images, descriptions, and availability may be updated when reasonably necessary.
Nothing in these terms removes any customer right provided by applicable Hong Kong law.
4. Product Safety and Electrical Items
Omnisculpta supplies decorative products in accordance with applicable Hong Kong product-safety requirements. Customers should follow the usage, placement, assembly, and warning information displayed on the product page or supplied with the item.
Electrical lamps and related products must be used only with the stated voltage, plug type, bulb specification, and intended environment. Customers must not modify electrical components, use incompatible fittings, exceed the stated wattage, or expose indoor products to water or unsuitable conditions.
Applicable requirements may include the Consumer Goods Safety Ordinance (Cap. 456), Consumer Goods Safety Regulation (Cap. 456A), and Electrical Products (Safety) Regulation (Cap. 406G). Nothing in these terms limits any obligation imposed on Omnisculpta as a supplier under Hong Kong law.
5. Prices and Cash on Delivery
All displayed prices apply to customers purchasing within Hong Kong. Omnisculpta uses Cash on Delivery as its payment method. Customers must pay the complete order amount in cash when the courier arrives. No online card payment is collected during checkout.
The customer should have the required cash available at the delivery address. If payment cannot be completed, the attempt may be recorded as a failed delivery and the order will be canceled automatically.
6. Order Journey
Our expected order journey contains two stages:
- Shipping preparation: 1 business day is used to prepare the order for courier collection.
- Transit: Delivery generally requires an additional 1 to 2 business days.
The expected total is 2 to 3 business days after order processing begins. Business days exclude Sundays, public holidays, and days when normal courier operations are unavailable.
Delivery estimates are not fixed promises. Weather, access restrictions, incorrect details, courier disruption, or events outside reasonable control may affect timing. We will communicate material delays when practical.
7. Cancellation Boundary
Customers may request cancellation while the product remains with Omnisculpta. Requests should be sent promptly to collective@omnisculpta.com with the order details.
Cancellation becomes unavailable once the parcel leaves our warehouse and is handed to the courier. Refusing a dispatched order does not restore the earlier cancellation option and may be recorded as a failed delivery.
A request is effective only when Omnisculpta acknowledges it before courier handover. Submitting an email alone does not establish that dispatch was stopped.
8. Delivery Responsibility
A person able to receive the parcel and pay the full Cash on Delivery amount must be present at the supplied address. Customers should keep their telephone available in case the courier needs directions or access assistance.
If nobody is available, the address is inaccessible, the recipient cannot be contacted, or sufficient cash is unavailable, the order will be deemed canceled following the failed delivery.
Failed deliveries may affect future orders associated with the customer, telephone number, or address. Omnisculpta may review, restrict, or decline later orders where repeated fulfillment costs or delivery disruption has occurred.
9. Thirty-Day Return Window
Eligible return requests must be submitted within 30 calendar days beginning on the delivery date. A return is available only when:
- The delivered item is damaged;
- The delivered item differs from the ordered product; or
- An incorrect size or product variant was delivered where the order offered a size or variant selection.
Returns are not available because of changed preference, unsuitable decor matching, an incorrect measurement selected by the customer, or another change-of-mind reason.
Customers should return the item with its original packaging, supplied parts, and accessories where reasonably possible. Missing or damaged packaging will not, by itself, remove a statutory right where the delivered goods fail to meet applicable legal requirements.
10. Review, Exchange, and Refund
After doorstep collection, Omnisculpta requires 24 hours to assess the returned item and the reported issue. Customers should provide order details and useful photographs when requested.
When the return meets these terms, an exchange will be arranged first. If the relevant replacement is unavailable, Omnisculpta will issue a refund by bank transfer.
Our exchange-first process is a voluntary commercial arrangement. It does not restrict any right to reject goods, obtain a refund, claim damages, or pursue another outcome available under applicable Hong Kong law.
Refund processing begins after the 24-hour assessment. Customers must provide accurate bank transfer details through the instructed communication channel. After processing, the amount may require up to 7 business days to appear, depending on the customer’s banking provider. Omnisculpta is not responsible for delays caused solely by that provider or inaccurate details.
11. Website Use and Intellectual Property
Website content, including text, graphics, product photographs, layouts, and original artwork imagery, belongs to Omnisculpta or its respective rights holder. Customers may browse the website and retain order information for personal use. Commercial copying, republication, alteration, or distribution without written permission is prohibited.
Users must not disrupt the website, introduce harmful code, misuse checkout, submit false information, impersonate another person, or attempt illegal access.
12. Legal Framework
These terms are governed by Hong Kong law. Relevant legislation includes the Sale of Goods Ordinance (Cap. 26), Trade Descriptions Ordinance (Cap. 362), Control of Exemption Clauses Ordinance (Cap. 71), Unconscionable Contracts Ordinance (Cap. 458), Consumer Goods Safety Ordinance (Cap. 456), Consumer Goods Safety Regulation (Cap. 456A), Electrical Products (Safety) Regulation (Cap. 406G), Electronic Transactions Ordinance (Cap. 553), Contracts (Rights of Third Parties) Ordinance (Cap. 623), and Personal Data (Privacy) Ordinance (Cap. 486).
Product descriptions and sales practices will be presented consistently with applicable consumer requirements. Contract limitations apply only to the extent permitted by law. If a term conflicts with a mandatory legal right, that right prevails and the remaining terms continue to operate.
13. Disputes and Contact
Customers should first contact collective@omnisculpta.com with their name, order reference, issue, and requested outcome. Omnisculpta will review the matter and seek a practical resolution.
Hong Kong courts have jurisdiction over disputes arising from these terms, subject to any applicable statutory rights or alternative process agreed by both parties.
We may revise these terms to reflect operational or legal changes. Updated terms apply from their published effective date and do not retroactively alter orders already accepted.
